SOLPAL Inc. Liability Policy:
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT
VARY FROM STATE TO STATE. OTHER THAN AS PERMITTED BY LAW, Solpal Inc DOES NOT EXCLUDE,
LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE
NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU
SHOULD CONSULT THE LAWS OF YOUR STATE.
The Products are solely distributed by Solpal Inc. in the United States, selling to retailers and end-us-
ers among other clients. This document serves as a statement of our limitation of liability Solpal Inc.
Solpal Inc. is responsible for the Products being free of defects in materials and workmanship that
Inc. guidelines and User Manual. With every purchase Solpal Inc. provides a User Manual that explains
the correct mode of installation, the basic risk of using the product, detailing the ideal use conditions
as well as warning of the dangers that accompany improper use. It is the sole responsibility of the
customer of any product sold by Solpal Inc. or its resellers to obtain proper instruction from the User
Manual and to always act safely, prudently and with caution while using our Products. All warranties
are only valid and operative when the User Manual is followed at all times. Solpal Inc. responsibility
is valid for a period of 5 years for Solpal product and 2 years for accessories for sales in all states of
America, excepted the states of California and Hawaii. For California and Hawaii the responsibility is
valid for a period of 10 years for Solpal product and 2 years for accessories, whereby for the calculation
of the time period, the production date according serial number on the type plate sticker shall always
be determinant, subject to the conditions, limitations and exclusions set forth below. This responsibility
stalled at its original place of installation. This warranty is valid only if the installation and the mainte-
nance of the Products are performed by a duly licensed professional such as a solar contractor, install-
er, contractor, plumber, HVAC or other solar specialist, and if all such work is documented properly. The
installation by a duly licensed solar contractor and the observance of and adherence to all installation
instructions is, without exception, a prerequisite for any warranty claim.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLU-
SIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRIT-
TEN, STATUTORY, EXPRESS OR IMPLIED. Solpal Inc. DISCLAIMS ALL STATUTORY AND IMPLIED WAR-
RANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
A PARTICULAR PURPO-SE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT-
PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, Solpal Inc. LIMITS
THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WAR-
RANTY AND, AT Solpal Inc. OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION)
MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.
EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, Solpal
Inc IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RE-
SULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY,
INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICI-
PATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS
OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS
OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED
INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY. UNDER NO CIRCUMSTANCES SHALL
Solpal Inc `S LIABILITY ARISING FROM OR RELATING TO THE PURCHASE OF THIS PRODUCT EXCEED,
IN THE AGGREGATE, THE PURCHASE PRICE FOR THE GOODS ORDERED HEREUNDER. THE FOREGOING
LIMITATION SHALL NOT APPLY TO ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLI-
GENT ACTS AND/OR OMISSIONS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT
APPLY TO YOU.
