FIVE YEar LImItEd WarrantY
Robertshaw warrants to the original contract installer, or to the original consumer user, that each new Robertshaw thermostat or accessory will be free of defects in materials and workmanship
under normal use and service for a period of five (5) years from the date of purchase (the "Warranty Period"). If any Product fails within the applicable Warranty Period, Robertshaw shall, at
its option, repair or replace the Product or credit the purchase price, provided the Product is returned to Robertshaw's facility or designated agent with transportation charges prepaid, and the
Product, upon examination by Robertshaw, is found not to conform to the Warranty. Cost of Product removal, labor, or reinstallation of new Product are not covered under this Warranty and are
not the responsibility of Robertshaw. Warranty on Products, parts, components and/or software sold, but not manufactured by Robertshaw, shall be expressly limited to the warranty terms of
the manufacturer of such products, components, parts and/or software.
This above warranty does not apply to: (i) batteries; (ii) any losses or damages due to misuse, use of the Products in other than their normal and customer manner, accident, abuse, water, fire,
neglect, normal wear and tear, negligence (other than Robertshaw's), unauthorized modification or alteration, use beyond rated capacity, unsuitable power sources or environmental conditions,
stripped threads, improper installation, repair, handling, maintenance or application or any other cause not the fault of Robertshaw.
THE FOREGOING WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE
AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL ROBERTSHAW BE LIABLE TO CONSUMER, CONTRACTOR, OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOSS OF PRODUCTION, LOSS OF GOODWILL, LOSS OF CONTRACTS, LOSS OF ANTICIPATED SAVINGS,
LOST REVENUES OR PROFITS, OR PROPERTY DAMAGE, REGARDLESS OF WHETHER SUCH LOSS OR DAMAGE IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, INDEMNITY,
PRODUCT LIABILITY, OR OTHERWISE, AND EVEN IF ROBERTSHAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
REPAIR, REPLACEMENT OR CREDIT OF THE PURCHASE PRICE SHALL CONSTITUTE THE SOLE REMEDIES WITH RESPECT TO DEFECTS IN THE PRODUCTS. THE CONSUMER ASSUMES ALL RISKS AND
LIABILITY FOR INCIDENTAL AND CONSEQUENTIAL DAMAGE RESULTING FROM INSTALLATION AND USE OF THE THERMOSTAT.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may
not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Return for Warranty Consideration
1. All Products to be considered for warranty must be returned to Company with shipping charges prepaid.
2. Product returned to Company must be packaged in such a manner that will prevent any further damage to the Product during transit. The Warranty terms above shall not apply to any items
damaged in transit.
3. An itemized packing slip, including owner's name and address, is required for each shipment to Company of Product(s) to be considered for warranty. The packing slip must contain reason
for warranty return, date of installation, date of failure, and a contact name in case further information is required.
4. Within North America (USA and Canada), all cartons must be clearly identified as WARRANTY PRODUCT and returned to:

Robertshaw garantit à l'installateur sous contrat initial ou au premier l'utilisateur/consommateur, que chaque nouveau thermostat Robertshaw ou accessoire sera exempt de défauts, pièces et
main d'oeuvre, dans des conditions normales d'utilisation, et ceci pendant une durée cinq (5) ans à compter de la date d'achat (la « Période de garantie »). Si un produit tombe en panne pendant
la période de garantie, Robertshaw, à sa seule discrétion, réparera, remplacera le produit ou créditera du montant du prix d'achat, à condition que le produit soit renvoyé aux établissements
Robertshaw ou à un agent mandaté, frais de transport payés à l'avance, et que le Produit, après examen par Robertshaw, soit jugé ne pas se conformer à la garantie. Les frais de recueil, de main
d'oeuvre, ou de réinstallation d'un nouveau produit ne sont pas couverts par cette garantie et ne sont pas du ressort de Robertshaw. La garantie sur les produits, pièces, composants et / ou
logiciels vendus, mais non fabriqués par Robertshaw, se limitera expressément aux termes de la garantie du fabricant de ces produits, composants, pièces et / ou logiciels.
Cette garantie ne concerne pas : (i) les piles ; (Ii) toute perte ou tout dommage dû à une mauvaise utilisation, utilisation inhabituelle et anormale des produits, à un accident, à un abus, à de l'eau,
à un incendie, une négligence, usure normale, manque de soin (autre que de la part de Robertshaw), modification ou altération interdite, utilisation dépassant la capacité nominale, sources
d'alimentation ou conditions environnementales inappropriées, fils dénudés, mauvaise installation, mauvaise réparation, mauvaise manutention, mauvais entretien ou mauvaise utilisation, ou
toute autre cause ne concernant pas Robertshaw.
LA GARANTIE PRÉCÉDENTE REMPLACE ET EXCLUT TOUTE AUTRE GARANTIE, EXPLICITE OU IMPLICITE, NOTAMMENT DE QUALITÉ MARCHANDE, TITRE ET ADÉQUATION À UN USAGE PARTICULIER.
EN AUCUN CAS ROBERTSHAW NE POURRA ÊTRE TENU RESPONSABLE VIS-À-VIS DU CONSOMMATEUR, ENTREPRENEUR, OU DE TOUT TIERS, DE TOUT DOMMAGE FORTUIT, SPÉCIAL, INDIRECT,
PUNITIF OU INDIRECT, NOTAMMENT ET SANS S'Y LIMITER, DE TOUTE PERTE D'UTILISATION, PERTE DE PRODUCTION, PERTE DE CLIENTÈLE, PERTE DE CONTRATS, PERTE D'ÉCONOMIES ANTICIPÉES,
PERTES DE REVENUS OU DE BÉNÉFICES, OU DE TOUT DOMMAGE MATÉRIEL, QU'ILS SOIENT FONDÉS CONTRACTUELLEMENT, PAR GARANTIE, NÉGLIGENCE, RESPONSABILITÉ ABSOLUE, INDEMNITÉ,
RESPONSABILITÉ VIS-À-VIS DU PRODUIT OU AUTRE, MÊME SI ROBERTSHAW EN A ÉTÉ INFORMÉ.
LA RÉPARATION, LE REMPLACEMENT OU LE CRÉDIT ÉQUIVALANT AU PRIX D'ACHAT, CONSTITUE LES UNIQUES RECOURS CONCERNANT LES DÉFAUTS AU NIVEAU DES PRODUITS. LE
CONSOMMATEUR ASSUME TOUT RISQUE ET RESPONSABILITÉ EN CAS DE DOMMAGES FORTUITS ET INDIRECTS RÉSULTANT DE L'INSTALLATION ET DE L'UTILISATION DU THERMOSTAT.
Certains États ne permettent pas l'exclusion ou la limitation des dommages fortuits ou indirects, ou autorisent des limitations sur la durée d'une garantie implicite, par conséquent, les limitations
ou exclusions ci-dessus peuvent ne pas vous concerner. Cette Garantie vous confère des droits spécifiques, et vous pouvez également disposer de plus amples droits variant d'un État à l'autre.

Robertshaw garantiza al contratista instalador original o al usuario final original, que todo nuevo termostato o accesorio Robertshaw estará libre de defectos en los materiales y fabricación bajo
condiciones normales de uso y servicio por un período de cinco (5) años a partir de la fecha de compra (el "Período de garantía"). Si alguno de los Productos falla dentro del Período de Garantía
aplicable, Robertshaw, a su propia discreción, reparará o reemplazará el Producto o acreditará el precio de compra, siempre que el Producto sea devuelto al establecimiento de Robertshaw o del
agente designado con los gastos de transporte prepagos, y que una vez examinado por Robertshaw se haya verificado que no cumple con las condiciones especificadas en la Garantía. Los costos de
retiro del producto, de la mano de obra o de la reinstalación del nuevo producto no están cubiertos por esta Garantía y no son responsabilidad de Robertshaw. La Garantía de los Productos, partes,
componentes y/o software vendidos pero no fabricados por Robertshaw se limitará expresamente a los términos de garantía del fabricante de dichos productos, partes, componentes y/o software.
La garantía que antecede no es aplicable a: i) pilas; ii) defectos o daños originados por el uso indebido, uso de los Productos de una manera distinta de la manera normal y habitual, accidente,
abuso, agua, fuego, descuido, deterioro y rotura normal, o negligencia que no recaiga sobre Robertshaw, modificaciones o alteraciones no autorizadas, el uso más allá de su capacidad evaluada,
fuentes de alimentación o condiciones ambientales inapropiadas, roscas deterioradas, instalación, reparación, manejo, mantenimiento o aplicación incorrectos o cualquier otra causa que no sea
culpa de Robertshaw.
LA GARANTÍA QUE ANTECEDE EXCLUYE A TODA OTRA GARANTÍA, EXPRESA O IMPLÍCITA, INCLUYENDO LAS GARANTÍAS IMPLÍCITAS DE APTITUD PARA COMERCIALIZACION, TITULARIDAD
Y APTITUD PARA DETERMINADAS APLICACIONES. EN NINGÚN CASO ROBERTSHAW SERÁ RESPONSABLE ANTE LOS CONSUMIDORES, CONTRATISTAS O TERCEROS POR DAÑOS ESPECIALES,
INDIRECTOS, INCIDENTALES, CONTINGENTES, DAÑOS Y PERJUICIOS CON CARACTER EJEMPLAR O PUNITIVOS RELACIONADOS CON EL USO DEL PRODUCTO, INCLUYENDO, EN FORMA NO TAXATIVA:
PÉRDIDA DE USO, PÉRDIDA DE PRODUCCIÓN, PÉRDIDA DE IMAGEN, PÉRIDA DE CONTRATOS, PÉRDIDA DE GANANCIAS ANTICIPADAS, PÉRIDA DE INGRESOS O LUCRO CESANTE Y DAÑO A LA
PROPIEDAD, INDEPENDIENTEMENTE DE QUE DICHA PÉRDIDA O DAÑO SE ORIGINE EN UNA RELACIÓN CONTRACTUAL, GARANTÍA, ACTO ILÍCITO, NEGLIGENCIA, RESPONSABILIDAD ESTRICTA,
INDEMNIZACIÓN, RESPONSABILIDAD DE PRODUCTO U OTROS, AÚN SI ROBERTSHAW HA SIDO NOTIFICADO SOBRE LA POSIBILIDAD DE DICHOS DAÑOS.
LA REPARACIÓN, EL REEMPLAZO DEL PRODUCTO O EL CRÉDITO POR EL PRECIO DE COMPRA SERÁ LA ÚNICA REPARACIÓN APLICABLE POR LOS DEFECTOS EN LOS PRODUCTOS. El CONSUMIDOR
ASUME TODOS LOS RIESGOS Y RESPONSABILIDADES POR DAÑOS INDIRECTOS O CONTINGENTES ORIGINADOS EN LA INSTALACIÓN Y EL USO DEL TERMOSTATO.
Algunos estados no permiten la exclusión o limitación de daños incidentales o indirectos ni permiten limitaciones al período de vigencia de la garantía implícita, por lo tanto las limitaciones antes
citadas pueden no ser aplicables en su caso. Esta Garantía le otorga derechos legales específicos y usted también puede tener otros derechos que varían de estado a estado.
