8.3
The warranty comes into force on the day of purchase
on which the end user acquires the product and is
restricted exclusively to the rights as set out in clause
8.3.2 unless otherwise covered by statutory warranty
rights.
8.3.1 The condition for performance of the warranty is that the
defective product is sent in within the warranty period with
the original receipt of purchase which must contain the
purchase date as well as the name of the company
making the initial sale.
8.3.2 At the discretion of ENDOR AG, the warranty covers
either free repair or exchange of parts of the product or
the exchange of the product as a whole.
8.3.3 For defects not covered by warranty or excluded
from performance of the warranty in accordance with
section 8.2.1 – 8.2.8, the local customer service
organisation or local dealer should be asked about
repair possibilities.
8.4
To the extent permitted by law, any other liability
arising from intent or gross negligence is excluded for
all direct or indirect damages and consequential
damages irrespective of the basis of the claim,
8.4.1 with respect to, in particular, damage to all property,
data loss, as well as economic loss such as lost profit
and transport damage in connection with returns to
ENDOR AG.
8.4.2 To the extent that in some countries or parts of countries,
warranty limitations in accordance with clause 8.4 are not
permitted by or effective in law, the restrictions will
apply to the extent that warranty exclusions can be agreed
in accordance with the respective national statutory and
legal situation.
