11.0 Guarantee
We guarantee this OASIS device for a period of 24 months. The guarantee period
starts with the first-time purchase from an OASE dealer. The guarantee period does
not start over again in the case of a subsequent sale.
We will repair, ship spare parts, or ship a new unit at our discretion to fulfill our
guarantee obligation. Our guarantee covers defects in materials or manufacturing.
Claims resulting from installation or operating errors, as well as from insufficient
care, non-conventional use, effects of freezing, calcium deposits, or attempted
repair from unauthorized personnel, are not covered by our guarantee. Parts
subject to wear and tear, like light bulbs for example, are not covered by this
guarantee. A more precise definition of parts subject to wear and tear is included
in the operating instructions, which are part of this guarantee. The legal rights of the
purchaser, particularly arising from the guarantee, continue in effect and are not
limited by this guarantee.
In case of negligence, our liability is limited to the immediate, average foreseeable
damage typical to the contract, according to the product type. This applies as well
for negligence on the part of our legal representatives or fulfillment partners. This
limitation of liability does not apply for customer claims arising from product liability.
In addition, this liability limitation applies for unforeseeable injury to life and health
of the customer or loss of life of the customer.
We manufacture using only quality materials. However if, in spite of our efforts, the
customer should have a legitimate claim, then we will decide at our discretion about
the type of fulfillment through no-charge rectification, for example repair or
replacement of defective parts, or shipment of a new unit. Should we decide for
repair, then the guarantee protection only covers repairs carried out by a repair
organization authorized by us.
If we fulfill the guarantee claim by spare part delivery, or repair, or shipment of a new
unit, then this does not cause a restart of the guarantee period.
Claims arising from this guarantee are only valid with submission of the sales
receipt to us, OASE Wübker GmbH & Co Kg, Tecklenburgerstr. 161 in 48477
Hörstel, Germany. The device or parts in question must be returned to us along with
your purchase receipt, this guarantee certificate, and written information describing
the claimed defect.
