4. Terms and conditions of warranty
Inter Product warrants, subject to the terms and conditions set forth below, that
its product is, at the time of shipment from IP, free from design, material,
manufacture and workmanship defects.
Should any defect in design, material, manufacture or workmanship arise within ten
years from the date of shipment by IP to the customer or distributor, then IP shall be
obligated to, free of charge to the customer, repair or replace, at the option of IP, the
product in which the defect arises. In the event that IP elects to "replace" a product, IP
shall issue the customer a credit for any defective product, equal to the purchase price
of the product after reasonable deduction for depreciation and use.
There are no warranties which extend beyond the description on the face hereof. In
light of the express warranty provided hereby, IP HEREBY EXCLUDES, TO THE FULLEST
EXTENT ALLOWED BY LAW, ANY AND ALL IMPLIED WARRANTIES THAT MIGHT OTHER-
WISE ARISE BY OPERATION OF LAW, INCLUDING THE WARRANTIES OF MERCHANTABILI-
TY OR FITNESS FOR A PARTICULAR PURPOSE.
Under no circumstances shall the liability of IP, under this warranty, exceed the purchase
price of the product claimed to be defective.
IP shall not be liable for any loss, damage, special or consequential damage of any
kind (including property damage and, if allowed by state law, personal injury) other
than that warranted above, regardless of whether that liability arises out of tort,
contract, or other theories of recovery.
The following terms and conditions, to the fullest extent allowed by law, shall govern
this Limited Express Written Warranty:
a.
The customer is obligated to provide IP a signed copy of the warranty certificate
prior to placing the IP product into operation.
b.
The customer is obligated to provide IP prompt written notice of any claim under
this warranty.
c.
The customer is obligated to ensure that IP products are employed in a manner
consistent with the Instruction Manual provided with the IP product.
d.
No warranty applies to IP products that have undergone alterations, repairs, or
disassembly performed by someone who is not an authorized by IP to conduct
such alterations, repairs or disassembly.
e.
No warranty shall apply to IP products that has parts incorporated into it or used
on or in conjunction with it that are not manufactured or authorized by IP.
