Limited Lifetime Warranty
* Applicable to all countries, except countries which have special warranty statements included in this document.
LIMITED LIFETIME WARRANTY
This limited lifetime warranty covers all Whispbar-brand products* and rack components manufactured by Y akima Products, Inc. (Y akima), and is effective for as long as
the original retail purchaser owns the product. This warranty terminates when the original retail purchaser sells or otherwise transfers the product to any other person.
Subject to Y akima's inspection of the product, Y akima will remedy defects in materials and/or workmanship by repairing or replacing, at Y akima's option, the defective
product without charge for parts or labor, subject to the limitations and exclusions described in this warranty. Y akima may elect, at its option, not to repair or replace a
defective product, in which case Y akima will issue to the original retail purchaser, at Y akima's option, either a refund equal to the purchase price paid for the product, or
a credit to be used toward the purchase of new Whispbar products or rack components.
This warranty does not cover problems caused by normal wear and tear (including, but not limited to, scratches, dents, tears, or aesthetic oxidation of surfaces,
or natural breakdown of colors and materials over extended time and use), commercial use, accidents, unlawful vehicle operation, or modi cations or repairs not
performed or authorized by Y akima.
In addition, this warranty does not cover problems resulting from conditions beyond Y akima's control including, but not limited to, theft, misuse, overloading, or failure
to assemble, mount or use the product in accordance with Y akima's written instructions or guidelines included with the product or made available to the original retail
purchaser.
If a product is believed to be defective, the original retail purchaser should contact the Whispbar dealer from whom it purchased the product, who will give the original
retail purchaser instructions on how to proceed. If the original retail purchaser is unable to contact the Whispbar dealer, or the dealer is not able to remedy the defect,
the original retail purchaser should contact Y akima by e-mail at: yakwarranty@ yakima.com, or phone 888.925.4621 for shipping instructions.
Upon contacting Y akima directly, a Y akima technician will provide the original retail purchaser with appropriate instructions for returning the product to Y akima. The
original retail purchaser will be responsible for the cost of mailing the product to Y akima. In order to receive any remedy under this warranty (either from a Whispbar
dealer, or from Y akima directly), proof of purchase in the form of an original purchase invoice or receipt is strictly required.
LIMITATION OF LIABILITY
REPAIR OR REPLACEMENT OF A DEFECTIVE PRODUCT , OR THE ISSUANCE OF A REFUND OR CREDIT (AS DETERMINED BY Y AKIMA), IS THE ORIGINAL RETAIL
PURCHASER'S EXCLUSIVE REMEDY UNDER THIS WARRANTY . DAMAGE OR INJURY TO THE ORIGINAL RETAIL PURCHASER, TO HIS OR HER VEHICLE, CARGO, OR
PROPERTY , AND/OR TO ANY OTHER PERSON OR PROPERTY IS NOT COVERED BY THIS WARRANTY . THIS WARRANTY IS EXPRESSLY MADE IN LIEU OF ANY AND ALL
OTHER EXPRESS WARRANTIES, WHETHER ORAL OR WRITTEN.
Y AKIMA'S SOLE LIABILITY IS LIMITED TO THE REMEDY SET FORTH ABOVE. IN NO EVENT WILL Y AKIMA BE LIABLE FOR ANY DIRECT , INDIRECT , CONSEQUENTIAL,
INCIDENTAL, SPECIAL, EXEMPLARY , OR PUNITIVE DAMAGES OR FOR ANY OTHER DAMAGES OF ANY KIND OR NATURE (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS
OR LOST SALES). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY
NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

GARANTIE LIMIT E VIE
La pr sente garantie vie limit e couvre tous les produits* et composantes de porte-bagage de marque Whispbar fabriqu s par Y akima Products, Inc. (Y akima), et
demeure en vigueur tant que l'acheteur au d tail d'origine est propri taire du produit. Cette garantie prend n quand l'acheteur au d tail d'origine vend ou c de d'une
autre fa on le produit une autre personne.
Sous r serve de l'inspection du produit par Y akima et des limitations et exclusions d crites ici, Y akima corrigera les vices de mat riau ou de fabrication en r parant ou en
rempla ant, au choix de Y akima, le produit d fectueux sans frais pour les pi ces ou la main d' uvre. Y akima peut d cider, sa discr tion, de ne pas r parer ou remplacer
le produit d fectueux ; dans ce cas Y akima remettra l'acheteur au d tail d'origine, la discr tion de Y akima, soit un remboursement correspondant au prix d'achat du
produit, soit un cr dit applicable l'achat de produits ou de composantes de porte-bagage Whispbar neufs.
Cette garantie ne couvre pas l'usure normale (comme entre autres les gratignures, les bosses, les d chirures ou l'oxydation super cielle, ou la d gradation naturelle
des couleurs ou des mat riaux caus e par le temps et une utilisation prolong e), l'utilisation commerciale ou les dommages r sultant d'un accident, de l'utilisation
ill gale du v hicule ou de modi cations ou r parations non ex cut es ou autoris es par Y akima.
De plus, cette garantie ne couvre pas les dommages cons cutifs des situations sur lesquelles Whispbar n'a aucun contr le, comme, entre autres, le vol, une mauvaise
utilisation et la surcharge, ou cons cutifs un assemblage, une installation ou une utilisation du produit ne correspondant pas aux instructions crites de Y akima fournies
avec le produit ou communiqu es l'acheteur au d tail d'origine.
S'il estime que son produit Y akima est d fectueux, l'acheteur au d tail d'origine doit s'adresser au d positaire Y akima chez qui le produit a t achet ; celui-ci indiquera
au client comment proc der. Si l'acheteur au d tail d'origine ne peut communiquer avec le d positaire Whispbar, ou si le d positaire ne peut corriger le d faut, l'acheteur
au d tail d'origine doit communiquer avec Y akima par courriel : yakwarranty@ yakima.com, ou par t l phone au (888) 925-
4621 pour obtenir des instructions d'exp dition.
Si l'acheteur au d tail d'origine contacte Y akima directement, un technicien de Y akima lui indiquera la mani re de retourner le produit Y akima. L 'acheteur au d tail
d'origine devra assumer les frais de transport jusqu' Y akima. A n de pouvoir se pr valoir de cette garantie (soit d'un d positaire Whispbar, soit directement de Y akima),
il est obligatoire de pr senter une preuve d'achat, sous forme soit de la facture originale soit du re u original.

Y AKIMA), CONSTITUE LE RECOURS EXCLUSIF DE L'ACHETEUR AU D TAIL ORIGINAL TOUT AU LONG DE LA DUREE DE VALIDITE DE CETTE GARANTIE. TOUT DOMMAGE
OU TOUTE BLESSURE INFLIG (E) L'ACHETEUR AU D TAIL ORIGINAL, SON V HICULE, SON CHARGEMENT , OU SA PROPRI T , ET/OU TOUTE AUTRE
PERSONNE OU TOUTE AUTRE PROPRI T , N'EST PAS COUVERT PAR CETTE GARANTIE. CETTE GARANTIE EST EXPRESS MENT FAITE POUR REMPLACER TOUTE
AUTRE GARANTIE EXPRESSE, QU'ELLE SOIT ORALE OU CRITE. LA SEULE RESPONSABILIT DE Y AKIMA EST LIMIT E AU RECOURS D VELOPP CI-DESSUS. EN AUCUN
CAS, Y AKIMA NE POURRA TRE TENUE POUR RESPONSABLE DES DOMMAGES DIRECTS, INDIRECTS, CONS QUENTS, EXEMPLAIRES OU PUNITIFS OU DE TOUT AUTRE
DOMMAGE DE QUELQUE NATURE QUE CE SOIT (Y COMPRIS, ENTRE AUTRES, DE MANQUES GAGNER OU DE VENTES MANQU ES).
