it does not apply if there has been improper or inadequate use of the Louis Vuitton Horizon Earphones
such as where:
• the instructions for use and activation of the product are not complied with;
• the product has been dismantled by the user or by unauthorized person;
• the product is used with a jailbroken or rooted mobile device;
• the product has been connected to non-recommended charging accessories or to other charging
accessories than those included in the original packaging of the Louis Vuitton Horizon Earphones;
• the product has been used or connected with non-compatible hardware (which shall include,
for the avoidance of doubt, any hardware not specifically recommended for use in connection
with the Earphones as described in the instructions for use);
• the product has been voluntarily degraded or used out of the recommended rules for usage
such as using the wrong charging accessories;
• the product has been exposed to extra voltage or electric discharges, important shocks,
drop or abnormal mechanical stress leading to major degradation of product housing
or electronic components;
• the product has been abnormally exposed to water or other chemical substances (presence
of corrosion, humidity);
• the product has been damaged by accident, abuse, misuse, fire, earthquake or other external cause;
• the product has been stolen (or Louis Vuitton reasonably believes the product has been stolen
based upon information provided by law enforcement authorities);
• the product has been exposed to high or cold temperature (Operate and store this product
within the temperature range of -4 °F to 113 °F (-20 °C to 45 °C) only) or extreme humidity range
(greater than 90%) or other extreme environmental conditions; or
