conformities or defects in the product reported by the consumer are covered by the
warranty and that the malfunction reported does not depend on improper use by the
consumer.
7.2 Should Laghetto ascertain that the product indeed features a defect or fault, the
Company shall, via the nearest authorized technical service centre & dealers and
according to the methods deemed most appropriate, repair the product and eliminate
any defects featured.
7.3 For the first two years from delivery of the product, the guarantee shall be provided
at no cost to the consumer. After two years to the duration indicated in the point 4 of
this certificate Laghetto shall continue to provide free of charge all materials necessary
to repair the product with the exception of labour costs (travel expenses and man
hours) which shall be paid by the consumer.
7.4 Should the product be installed in a poorly accessible location, or together with
rare or valuable materials, the expenses, such as, for example, those incurred for
the removal, transportation and repositioning of the product in its original point of
installation, as well as the cost of repairing the rare and/or valuable materials, shall be
payable by the Consumer.
8.
DAMAGE LIABILITY
Laghetto shall not be held responsible for any direct or indirect injury and damage to
persons, pets and/or objects caused by failure to observe all the directions indicated
in documentation relating to the product, especially warnings given in connection with
assembly, installation, use and maintenance of the product itself, and/or following use
of the product that does not comply with the diligence required by the nature of the
same.
9.
APPLICABLE LAW – COURT WITH JURISDICTION
The Laghetto Guarantee is governed by Italian law and the court of Cremona (CR) in
Italy shall have sole jurisdiction in the event of any dispute relating to it.
