Warranty Disclaimer/Limitation of Liability
HD Supply Facilities Maintenance does not provide any warranty for the goods it supplies, but shall pass
through any transferable manufacturer's standard warranties. HD Supply Facilities Maintenance excludes and
disclaims all other express and implied warranties, including, but not limited to, all implied warranties of
merchantability fitness for a particular purpose. To the extent not prohibited by applicable law, in no event,
whether in contract, warranty, indemnity, tort (including, but not limited to, negligence), strict liability or
otherwise, shall HD Supply Facilities Maintenance or its affiliates be liable for (a) any incidental, indirect,
punitive, special, consequential, or similar damages, even if such damages were foreseeable or caused by HD
Supply Facilities Maintenance, (b) any claim that properly is a claim against the manufacturer, or (c) any
amount exceeding the amount paid for goods that are subject of such claim(s). All claims must be brought
within one year of accrual of cause of action.
The manufacturer warrants only to customers for resale, or for use in business, against defects in workmanship
or materials under normal use for three years after date of purchase from HD Supply Facilities Maintenance. If
it is determined that such products are defective and are returned to an HD Supply Facilities Maintenance
distribution center as designated (shipping costs prepaid), there will be an option for repair, replace or refund
as the customer's exclusive remedy.
The manufacturer makes no other warranty or affirmation of fact, express or implied, other than as set above.
The manufacturer specifically disclaims any liability for product defects due to product misuse, improper
product selection, misapplication or trade usage. No product description expresses or implies a warranty that
the products are merchantable, fit for a particular purpose or free from the infringement claims. To the extent
an implied warranty cannot be excluded, such warranty is limited in duration to the express warranty period.
Because some states or jurisdictions do not allow limitations on duration of implied warranties, the above
limitation may not apply. This warranty gives the customer specific legal rights, and the customer may also
have other rights, which vary from jurisdiction to jurisdiction. This disclaimer shall apply even if the express
warranty above fails of its essential purpose.
Any liability for consequential, incidental, special, exemplary, or punitive damages is expressly disclaimed.
Liability in all events is limited to, and shall not exceed the purchase price paid for the product that gives rise to
any liability.
Prompt Disposition
HD Supply Facilities Maintenance will work with the manufacturer to promptly attempt to correct or adjust any
product determined to be defective within warranty period. Before returning any product, contact Customer
Care at 1-800-431-3000. Please provide the date of purchase, original invoice number, and a description of the
defect.
Product Suitability
Many states and localities have codes and regulations governing sales, construction, installation, and/or use of
products, which may vary. While the manufacturer attempts to assure that its products comply with such codes,
it cannot guarantee compliance, and cannot be responsible for how the product is installed or used. Before
purchase and use of a product, please review the product application and national and local codes and
regulations, to be sure that the product, installation, and use will comply.
No Warranties to Consumers
There is no warranty to those defined as consumers in the Magnuson-Moss Warranty-Federal Trade
Commission Improvement Act.
