N oken D esign,S . A. in the U nited S tates of America, C anada and M ex i co ( " C ompany" ) hereby w arrants to the original buyer ( " Buyer" ) that the faucets sold
by the C ompany under the N oken brand on or after J u ne 1 , 2 0 0 7 ( " P roducts" ) w ill be reasonably free of defects in materials and w orkmanship upon delivery
and, when properly handled and installed, will conform to applicable manufacturing specifications.
C O M M E R C I AL W AR R AN T Y
I n the event that any of the P roducts sold for installation in a commercial setting or sold to a contractor or other commercial Buyer for installation in a
residential setting are found to be defective, the C ompany w ill, at its sole option, repair, replace or adj ust the defective P roducts ( or affected components) ,
provided that the Buyer has given w ritten notice of defect to the C ompany w ithin 2 4 months of the original purchase date in the case of uninstalled P roducts
or P roducts installed in a commercial setting or w ithin 2 4 months of the original purchase date in the case of P roducts installed in a residential setting. T his
24 month period applies to the chrome plated surface. In case of any other finish the warranty period will be 12 month. For electronic components, internal
components and hoses the w arranty period w ill be 1 2 month. T his w arranty ex c l udes any labour charges, installation,or other conseq uential losses or
incidental damages. T his w arranty is also subj ect to the limitationsset out below under " O ther W arranty I nformation" and to those set forth in any applicable
terms and conditions of sale.

I n the event that any of the P roducts sold to a non-commercial Buyer and installed in a residential setting should drip or leak during normal residential use,
the C ompany w ill provide the buyer the necessary parts to return the P roducts to good w orking condition. F or any other defects in material and w orkmanship
found to ex i st in the P roducts, the C ompany w ill, at its sole option, repair, replace or adj ust the P roducts ( or affected components) . T his w arranty covers the
chrome plated surface of the Products installed in the Buyer's home as long as the buyer owns it. In case of other finishes the warranty period is 12 month for
the surface. F or electronic components, internal components and hoses the w arranty period w ill be 1 2 month. T his w arranty is subj ect to ( a) the C ompany's
receipt of w ritten notice from the Buyer of the alleged failure or defect w ithin the term of w arranty, together w ith proof of purchase ( original sales receipt) , and
( b) the limitations set out below under " O ther W arranty I nformation" and those set forth in any applicable terms and conditions of sale.
O T H E R W AR R AN T Y I N F O R M AT I O N
T he C ompany makes no ex p ress or implied w arranty that the P roducts are suitable for any particular purpose and makes no w arranties other than the
commercial w arranty and the residential w arranty set forth above. S uch w arranties ( " this w arranty" ) shall be void upon the occurrence of any one or more
of the follow ing events: ( a) defects, damage or failure caused by the carrier, installer or any other third party; ( b) the P roducts are installed in a w ay that
is contrary to specifications applicable to the Products; (c) the Products are damaged or malfunction as a result of modifications of any type made to the
P roducts for any reason, or components supplied by the installer; ( d) damage caused by accident, misuse, or careless handling, including, w ithout limitation,
in the case of bathtubs lifting unit by plumbing and abrading finish; (e) damages caused by incorrect operation, or operation in conflict with any written
specifications provided by the Company; (f) the Products are damaged because of lack of proper routine maintenance, or use of abrasive or improper
cleaners; ( g) defects or damage that could and should have been discovered, repaired or avoided by proper inspection and testing before installation; and
(h) the Products are damaged by acts of God, such as storms, floods, lightning earthquakes and other natural disasters.
This warranty does not cover variations in color or shade fidelity between catalogue images and the actual Products, nor does it include labour, transportation,
or other costs incurred in the removal and/ or reinstallation of the original P roducts and/ or installation of replacement P roducts, or any costs incurred in
obtaining access for repair. T o the max i mum ex t ent permitted by applicable law , the C ompany ex p ressly ex c l udes from this w arranty, and w ill not pay for, any
conseq uential losses and incidental damages. T his w arranty ex t ends only to the Buyer and is not transferable.
This warranty gives you specific legal Rights, and you may also have other Rights that vary from state to state. The Company will not be responsible for any
statements or representations made in any form that go beyond, are broader than, or are inconsistent with any authorized literature or written specifications
furnished by the C ompany. S ome states do not allow limitations on how long an implied w arranty lasts, or on special, incidental, or conseq uential damages.
As a result, some of these limitations may not apply to you.
