If the Product is determined to need full replacement, USL may refund the lower of a
pro-rata portion of the purchase price as determined below or the advertised selling
price of comparable Product at the time of adjustment. Pro-rata basis of the price is
determined by the following calculation: 0-2 years of ownership, 100% refund of original
purchase price. Over 2 years to 4 years of ownership, 80% refund of original purchase
price. Over 4 years to 6 years of ownership, 60% refund of the original purchase price.
Over 6 years to 8 years of ownership, 40% refund of the original purchase price. Over 8
years of ownership to completion of the warranty, 20% of original purchase price. Taxes,
shipping costs, inconvenience, loss of use, installation fees, incidental or consequential
damages will not be covered in the adjustment.
THIS WARRANTY IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, LIABILITIES OR
OBLIGATIONS OF US LEISURE EITHER EXPRESSED OR IMPLIED, EXCEPT THAT
THE DURATION OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN TIME TO THE DURATION
OF THIS WARRANTY. US LEISURE SHALL IN NO EVENT BE LIABLE FOR
CONSEQUENTIAL OR INCIDENTAL OR SPECIAL DAMAGES OF ANY KIND FOR
BREACH OF ANY EXPRESS WRITTEN OR ORAL OR IMPLIED WARRANTY ON
PRODUCTS. YOUR EXCLUSIVE REMEDY SHALL BE ENFORCEMENT OF THIS
WARRANTY UPON THE TERMS AND CONDITIONS HEREIN CONTAINED. NO
REPRESENTATIVE OF US LEISURE OR ITS DISTRIBUTORS OR DEALERS IS
AUTHORIZED TO MAKE ANY CHANGE OR MODIFICATION TO THIS WARRANTY.
Some jurisdictions do not allow limitation on how long an implied warranty lasts, so the
limitations contained herein above may not apply to you. Some jurisdictions do not allow
the exclusion or limitation on consequential or special damage, so the above limitations
or exclusions may not apply to you. This warranty gives you specific legal rights, and
you may also have other rights, all of which vary from jurisdiction to jurisdiction.
