damages, the aforementioned limitations and exclusions may not apply.
The liability limit of i'm S.p.A. towards consumers for the entirety of the damage (excluding
what foreseen by an applicable personal injury laws) can under no circumstances exceed
an amount of two hundred and fty euro. The aforementioned limits also apply even when
such compensation does not cover the actual damage.
It remains understood that the forecasts contained in these terms and conditions shall not in
any manner exclude or limit the liability of i'm S.p.A. in cases of (i) fraud, (ii) fatal or personal
injuries caused by the negligence of i'm S.p.A., or (iii) any liability which cannot be limited or
excluded by law.
9. Digital Certi cates
The i'm Watch software contains certain functions that allow users to accept digital certi cates
issued by i'm S.p.A. or other third parties. The user is the sole party responsible for deciding
whether or not to trust a certi cate issued by i'm S.p.A. or other third parties. The use of digital
certi cates is at the sole risk of users. To the extent permitted, and pursuant to applicable law,
i'm S.p.A. provides no statement or warranty, express or implied, regarding the marketability
or suitability for speci c purposes, the accuracy, security or non-infringement of third party
rights regarding the use of digital certi cates.
10. Software exporting terms
You are only permitted to use, export or re-export the i'm Watch software in accordance
with the laws of the United States of America or the country where the i'm Watch software
was purchased.
In particular, but without limitation, you are not permitted to export or re-export the i'm
Watch software (a) in any country subject to embargo by the United States or (b) to anyone
on the list of the US Treasury Department called Specially Designated Nationals or the U.S.
Trade Department Denied Person List or Entity List (c) in violation of the provisions of the EU
export control laws and other laws in force in the countries to which the i'm Watch is delivered
or used. On using the i'm Watch software, the user expressly declares and guarantees he or
she is not located in any of such countries, and does not appear on any of the aforementioned
lists. The user also undertakes to accept to refrain from using the i'm Watch software for any
purposes prohibited by United States law, including, without limitation, the development,
