V. Exclusions
The following items, among others compatible with the foregoing, are not covered by the warranty:
1. Point installation services;
2. Consulting services;
3. Components external to the Product;
4. Cleaning, conservation and normal wear and tear materials;
5. Papers and glasses;
6. Preventive maintenance labor;
7. Qualification and process validation tests;
8. Periodic calibration and calibration of measuring and control instruments;
9. Software update of the controller (when applicable), except in cases where proven program failures impair
operating and safety conditions;
10. Travel expenses and stays of the technician, freight, packaging and insurance;
11. Costs with outsourcing processes due to corrective and preventive maintenance;
12. Damage caused by failures in the supply of water, electricity (interruption, under or over voltage, transients)
or other changes after the installation qualification;
13. Damage caused by misuse, abuse, falling, neglect, recklessness or malpractice;
14. Damage caused by storage or use in conditions outside the specifications contained in the Instructions for
Use or product manual;
15. Damage caused by equipment that produces or induces electromagnetic interference outside the normative
limits;
16. Damage caused by accessories and Third Party Products added to a Product marketed by Baumer SA;
17. Damage caused by violation of the Product, attempted repair or adjustment by third parties not authorized
by Baumer SA;
18. Damage caused by agents of nature, such as electrical discharges (lightning), floods, fires, landslides,
earthquakes, etc;
19. Losses and damages caused by the Product or by the performance of the product, including, but not limited
to, loss of profits, financial losses and productivity limitations, resulting from acts related to hypotheses of not
covering this guarantee;
20. Damage caused to the installed product after the expiration of the warranty periods described above;
21. Damage caused to the Product due to transportation.
VI. Manufacturer's Liability Limitations
1. The obligations assumed by Baumer SA as a result of this Warranty Term are limited to those expressly
included herein;
2. The solutions provided in this Warranty Term are the only and exclusive solutions offered to the customer;
3. Under no circumstances will Baumer SA be liable for any direct, indirect damages, including loss of profits,
special, incidental or consequences, whether based on contract, lawful act, loss or other legal theory;
4. Under no circumstances will Baumer SA's liability for material damage exceed the maximum price limit for the
Product that caused such damage.
VII. Additional Warranties
Extended and / or special guarantees will be the subject of separate negotiation between Baumer SA and the
Buyer.
After contracting, they will be registered in a specific supply contract for this purpose.
VIII. Others
In accordance with the policy of continuous development, Baumer SA reserves the right to make, without prior
notification, changes to the product mentioned in this document.
All rights reserved. No part of this publication may be reproduced, stored in an information retrieval system, or
transmitted in any form or by any means, whether electronic, mechanical, photocopy, recording or in any other
way, without the prior authorization of Baumer SA.
