LIMITED WARRANTY

This Limited Warranty is in addi� on to any statutory rights of the purchaser pursuant to applicable law. Qura guarantees that all reasonable
precau� ons have been taken during the manufacture of this medical device, as required by the nature of the device and its intended use.
Qura guarantees that its medical device is capable of func� oning as indicated in these Instruc� ons For Use when used in accordance with
that specifi ed in these Instruc� ons by qualifi ed personnel and within the expiry date indicated on the packaging. However, Qura cannot
guarantee that the user will use the device correctly, nor that incorrect diagnosis or therapy and/or the par� cular physical and biological
characteris� cs of an individual pa� ent do not aff ect the performance and eff ec� veness of the device or cause damaging consequences
for the pa� ent, even though the specifi ed Instruc� ons for Use have been respected. Whilst emphasising the need to adhere strictly
to the Instruc� ons for Use and to adopt all the precau� ons necessary for correct use of the device, Qura therefore cannot assume any
responsibility for any incidents, harm, loss, expense or consequences arising directly or indirectly from improper use of, tampering with
or modifi ca� ons made to this device. Qura will replace the medical device if it is defec� ve at the � me it is put on the market or while
being shipped by Qura up to the � me of delivery to the fi nal user unless such defect has been caused by mishandling by the purchaser.
The above replaces all other warran� es, explicit or implicit, wri� en or verbal, including warran� es of marketability and/or func� onality.
No person, including any representa� ve, agent, dealer, distributor or intermediary of Qura or any other industrial or commercial
organiza� on is authorized to make any representa� on or warranty concerning this medical device except as expressly stated herein.
Qura disclaims any varia� ons to this Limited Warranty and to the informa� on/Instruc� ons for Use as explicitly contained herein.
The purchaser pledges to comply with the terms of this Limited Warranty and in par� cular agrees, in the event of a dispute or li� ga� on
with Qura, not to make claims based on alleged or proven changes or altera� ons made to this Limited Warranty by any representa� ve,
agent, dealer, distributor or other intermediary. The rela� onship between the par� es regarding the contract (even if not s� pulated
in wri� ng) to whom this warranty is issued, as well as any dispute related to it or in any way connected with it, as well as any rela� onship
or dispute concerning this warranty, its interpreta� on and execu� on, nothing excluded and/or reserved, are governed exclusively by
Italian law and jurisdic� on. The court appointed in the event of the above-said disputes shall exclusively be the Court of Modena (Italy).
