the maintenance programme, not later than 40 months after having been
acquired by the first customer. The postmark attesting to the date of
dispatch is decisive for establishing observance of the time-limit. The
maintenance programme has been specially designed to ensure trouble
free daily use of the prosthetic device.
In order for the maintenance programme to be carried out, the whole
PROPRIO FOOT must be sent in BIONIC product packaging. The
PROPRIO FOOT should be packed in BIONIC product packaging in
order to guarantee safe transport. The PROPRIO FOOT will be sent to
Össur by the customer at the latter´s risk and Össur therefore
recommends that appropriate transport insurance coverage is applied
(for loss or damage of the product) by the customer. Össur will, however,
bear the costs of transport back to the customer.
At the request of the customer and subject to availability, Össur will place
a loaner unit at the disposal of the customer, free of charge, for the
duration of an under-warranty service. The loaner unit must be returned
to Össur not later than 7 days after the serviced unit has been returned.
Össur reserves the right to charge a daily fee for each day past the return
date. Össur reserves the right to charge the full price of the loaner if it is
not returned within three weeks from the return date. Upon return of the
serviced PROPRIO FOOT, Össur will remind the customer of the
obligation to return the loaner unit within the stipulated period of time
and also point out that a failure to return the loaner unit within the
stipulated period of time will be construed as a statement accepting a
purchase contract relating to the loaner unit, unless Össur receives an
explicit statement to the contrary from the customer, prior to expiry of the
time-limit.

Any complaints and returned products under the terms of this limited
manufacturer's warranty must be made/sent to Össur Customer Service.
WARRANTY EXCLUSIONS
The following cases are – at the discretion of Össur – excluded from this
limited manufacturer's warranty:
a. Excluded from the warranty are software components, cables and
plugs generally included in the product package, as well as test and
sample products.
b. A warranty coverage will not be effective in the event of a defect
caused to the PROPRIO FOOT through a failure to use the
PROPRIO FOOT according to the Instructions for Use, improper use
or abuse of the PROPRIO FOOT.
c. The warranty expires:
1. In the event that inspections, adjustments, installations, maintenance
work, changes,modifications or other servicing is carried out by the
customer or a third party not authorised thereto by Össur. even the
removal of the rear cover will result in forfeiture of the warranty and
serves as evidence of the unauthorised intervention.
2. In respect of products whose serial number and/or data sticker has
been removed, changed or obliterated.
3. In the event of resale, except by an authorized distributor.
OTHER STIPULATIONS
a. This limited warranty replaces all other warranties and declarations of
