10 Guarantee

Section 1 Extent of the guarantee
1. The Manufacturer/Guarantor grants the Buyer/Beneficiary a
Guarantee encompassing the functionality of the components
listed in Section 2 for a period of two (2) years.
2. If one of the aforementioned components becomes defective
during the warranty period, the Buyer/Beneficiary can demand
to have the function restored professionally by replacement
or repair of the defective component. This guarantee does
not give the beneficiary the right to rescind the purchase
agreement or to reduce the purchase price. The Manufacturer
shall repair, at no charge to the Beneficiary, any defect of the
Device covered by this Guarantee caused by a defect in
material or workmanship, provided such defects are reported
immediately after discovery.
3. The repair work covered by this Guarantee shall include any
testing, measurements and adjustments required to repair a
defect covered by this Guarantee; it shall not cover standard
maintenance tasks recommended by the Manufacturer.
Section 2 Extent of the guarantee
1. The Guarantees shall include all component groups and
components of the Device.
2. To be eligible for any claims under this Guarantee, the Benefi-
ciary shall be report the defect, at the same time presenting a
copy of the original invoice.
3. Services under this Guarantee shall not extend nor re-start
the term of this Guarantee.
4. The guarantee term for any replacement parts installed in the
Device shall end concurrently with the guarantee term of the
entire device.
Section 3 Exclusions
1. This Guarantee shall be void if any persons not expressly
authorized by the Manufacturer/Guarantor make repairs or
other modifications that are beyond the normal use of the
Device or if a Device made by the Manufacturer/Guarantor is
equipped with replacement parts not specifically approved
for that Device.
2. This Guarantee shall not cover any transport damage, i.e. any
damage caused by direct physical external mechanical force.
3. This Warranty shall be void if the Device is used improperly,
in a way not described in the Instructions for Use, or for any
other undue purposes.

4. The Manufacturer/Guarantor shall not be liable for any claims
beyond those described in Section 1, including but not limited
to liability for any damage caused outside the Device, unless
liability is irrevocably assigned to the Manufacturer/Guarantor
under the law.
Section 4 Obligations of the Buyer/Beneficiary
1. The Buyer shall have all maintenance, calibration and care
tasks recommended for the Device in its Instructions for Use
performed by the Depot/Seller or at a workshop authorized
by Dentsply.
2. Before putting the Device into service, the directions of the
Instructions for Use for proper use of the Device shall be
followed in their entirety.
3. The special packaging shall be kept in a safe place, and in
the event of any repairs, the Device shall be packaged as per
the packaging instructions.
Section 5 Assignment and statute of limitations
1. If the Device covered by this Guarantee is sold to a third party,
the terms and conditions of this Guarantee shall apply to the
subsequent purchaser along with ownership of the Device.
2. Any claims under this Guarantee shall be subject to a limitation
period of six (6) months ending no later than six (6) months
following the end of the guarantee term.
Section 6 Neglected obligations
If the Buyer/Beneficiary fails to meet his or her obligations under
Section 4 para. 1 and 2, the Manufacturer/Guarantor shall be free
from all obligations under this Guarantee.
Section 7 Statutory warranty
This Guarantee does not cover the statutory warranty. The terms
of the statutory warranty shall apply in addition to the term of
this Guarantee. If the Buyer/Beneficiary fails to meet his or her
obligations under Section 4 para. 1 and 2, the warranty shall be
void, unless the Buyer can show that his or her failure to meet
his or her obligations did not result in any damage.
Section 8 Governing Law
This Guarantee shall be covered by German law. The place of
jurisdiction shall be Hanau am Main, Germany.
Notice: The Terms and Conditions of the device manufacturers
shall apply.
